Based on its stated reasoning, the lower court upheld the first instance judgment that acquitted the Defendant on the grounds that the Defendant’s act does not violate the social rules of Article 20 of the Criminal Act, and thus constitutes a justifiable act and thus, the illegality is excluded.

Examining the record in accordance with the relevant legal principles, the lower court did not err by misapprehending the legal doctrine on justifiable acts.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
