1. All of the plaintiffs' claims are dismissed.

2. The costs of lawsuit are assessed against the plaintiffs.

Reasons

1. Basic facts

A. The Defendant is a company running taxi passenger transportation business, etc. in the Gu and Si/Gu, and the Plaintiffs concluded a labor contract with the Defendant and work as from each day indicated in the “Date of Admission” in the annexed Table 1 Retirement Allowance Calculation Table, and retired on each day indicated in the same Table.

B. The Plaintiffs received each wage in the fixed amount scheme [referring to the wage payment scheme to which taxi drivers belong to individuals while paying the standard taxi commission (the full taxi commission) from the total daily transportation income to the company, and the remaining transportation income belongs].

C. The Defendant and the Defendant’s trade union (hereinafter “this case’s trade union”) concluded a wage agreement and collective agreement (hereinafter “instant wage agreement”) as follows:

1. The daily revenues shall be 122,000 won (including reserve funds) and shall be applied separately to employees who wish to work in a pet vehicle;

3. Wages shall be KRW 338,00 per month on a full-time basis (including allowances - family allowances and bonuses separately), and shall be calculated and paid in proportion to the actual attendance date;

4. To immediately commence negotiations on wages when increasing taxi charges in the future;

5. The term of validity of a wage agreement shall be from June 1, 2011 to May 31, 2012;

1) On May 9, 201, the Defendant and the Gyeongbuk Regional Headquarters of the Labor Union accepted a proposal for the following wage agreements as presented by the Gyeongbuk Regional Labor Relations Commission. Article 2 (Basic Policy) of the Wage Convention of 2011 (Basic Policy)

1. A company and its members shall, in principle, implement the total management system and monthly wage system of transportation income generated by operating vehicles of a company, and shall be implemented on a basis suitable for reality, taking into account the characteristics of the business and the circumstances of the regional economy;

Article 3 (Work Method)

Provided, That the form of work under this wage agreement is agreed to be on a daily basis.
