A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
1. Around 23:00 on July 27, 2013, the Defendant was under the influence of blood alcohol level of 0.158% without obtaining a driver’s license from a section of about 1km, which is located in the Sinsan-si Transportdong in the same Sinsan-si, to the front day of the same city, and driving a B rocketing car without obtaining a driver’s license.
2. On July 27, 2013, the Defendant violated the Resident Registration Act: (a) around 23:10, the Defendant demanded the verification of identity from the slope C belonging to the transportation management department of the military police station in front of the Korea-do, the Defendant, who was working as his/her her vegetator, and (b) stated D’s resident registration number to C without the consent of D.
Accordingly, the defendant used another person's resident registration number unlawfully.
3. Forgery of private documents;
A. On July 27, 2013, the Defendant committed the crime of July 27, 2013, around 2013: (a) around 23:10, the Defendant controlled the traffic management system of the Military Police Station in the direction of driving under drinking on the road located in the Donsan-si, Gunsan-si; (b) entered the driver’s statement in the driver’s statement column of the circumstantial report on the driver’s statement; (c) entered the driver’s column into the driver’s statement using the verification color pen in the “Silsan E”, “D”, “B” in the name column, “B”, “G”, and “D” in the “W” column of the blood collection statement form, and signed D’s statement in the “W” column.
Accordingly, the defendant, for the purpose of exercising a certificate of fact, forged the main driver's circumstantial statement and the written consent to blood collection in the name of D, which is a private document related to the certificate of fact.
B. On August 5, 2013, the Defendant committed a crime on August 5, 2013, when he/she was investigated by a traffic control assistant H of the Military Police Station at around 12:00 on August 5, 2013 from the Military Police Station Traffic Control Assistant H of the Military Police Station, and then is in color “D” in the driver’s name column of the report on detection of drinking drivers.
