부동산매도청구의 소
1. The remaining Defendants except the Defendant (Counterclaim Plaintiff) E, R, S, and U are attached Table from the Plaintiff (Counterclaim Defendant).
A principal lawsuit and a counterclaim shall be deemed as the same.
1. Basic facts
A. The Plaintiff is a housing reconstruction association which obtained authorization for the establishment of a housing reconstruction project association from the head of Gangseo-gu Seoul Metropolitan Government on March 20, 2017 pursuant to the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter “Urban Improvement Act”) for a housing reconstruction project of 31,237 square meters in Gangseo-gu Seoul Metropolitan Government, for the housing reconstruction project (hereinafter “instant project”).
The Defendants did not agree to the establishment of the Housing Reconstruction Association as the owners of land, etc. within the instant business zone, and did not become a member of the Plaintiff.
B. On March 31, 2017, the Plaintiff sent a written peremptory notice stating that the owner of the land, etc. in the instant project zone consented to the establishment of the association and would not participate in re-building if he/she did not reply thereto, by mail proving the content of the agreement.
C. The Defendants are the owners of each of the relevant real estate indicated in the attached Table “real estate” column, which is within the housing reconstruction rearrangement project.
