For the reasons indicated in its holding, the lower court upheld the first instance judgment convicting of the instant facts charged (excluding the part not guilty).

Examining the reasoning in light of the relevant legal principles and evidence duly admitted, the lower court did not err in its judgment by misapprehending the bounds of the principle of free evaluation of evidence against logical and empirical rules, or by misapprehending the scope of adjudication by the retrial court, the false perception of defamation, and the legal principles as to the grounds for exclusion of illegality as prescribed in Article 310 of the Criminal Act

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
