Criminal facts
1. On May 7, 2015, from around 21:00 to 21:30, the Defendant, along with B, found the second floor of the building located in Ansan-gu, Ansan-si, the victim C’s operation, and caused the disturbance by saying, while under the influence of alcohol, the Defendant: (a) was able to avoid the disturbance by “where he was able to use a singing prior to a certain time; (b) the wall and Handphone was lost; and (c) the CCTV was displayed.”
Although the victim continued to use the room in the instant singing room, it was not found that the lost material was lost. “CCTV did not embling inside and embly embly embly embly embly, and embly embly embly embly embly embly embly,” and the Defendant and B tried to see CCTV by misunderstanding that the victim did not intentionally show CCTV after acquiring the lost material and intentionally embly embly embly embling the victim.
Accordingly, the Defendant conspiredd with B to interfere with the victim's singing business by force for about 30 minutes.
2. The Defendant: (a) heard the explanation that “The CCTV may be confirmed by the procedure upon receipt of the case,” from G, a slope of the F District Police Station in the Ansan-gu Police Station, which was called out after receiving a report from C at the date, time, at the place specified in paragraph (1) of this Article; and (b) made a call to G by enhancing that “the police officer does not have to issue the CCTV, and does not defend the owner of the business,” while making a call, he would directly check CCTV; (b) had the said business operator enter the Kater of the said business while making a call to check CCTV; (c) had the said business operator check CCTV; and (d) caused the assault, such as sub-fluoring G’s chest on the two hand, and continuously stopping G, who continued to restrain him.
Accordingly, the defendant assaulted G and interfered with the legitimate execution of police officers' duties on the maintenance of order.
