If the defendant does not pay the above fine, KRW 100,000.

The defendant is the owner of other ship B (87 tons) and is the "person without a room" under the Marine Environment Management Act if pollutants, such as oil, are discharged on the ship.

1. No person shall discharge pollutants, such as oil, from ships into the sea;

Nevertheless, from the date of the trial to July 29, 2017, the Defendant left B at the sea of the Incheon Jung-gu Coast Guard located in Jung-gu, Incheon.

In such cases, the Defendant, as the owner of the vessel, has a duty to regularly check the fixed state of the vessel or to prevent various accidents, such as flood sinking of the vessel, oil leakage, etc. which may occur, but neglected to check on the ground that he/she did not frequently check the situation, and neglected to maintain and manage the vessel by setting the manager.

Around July 29, 2017, the Defendant, by the foregoing negligence, continuously flowed sea water inside B, which was anchored at the above place on July 29, 2017, and flood sinking, discharged approximately 600 liter A oil, which was stored in the hull oil tank and the oil reservoir.

② Since then, the Defendant did not take measures such as taking measures for pollution response and taking measures for pollution response against the aforementioned vessel in compliance with an order issued by the State, etc. (the Incheon Coast Guard and the Korea Marine Environment Management Corporation) to urgently drained the sea water flowing inside the above vessel under the Marine Environment Management Act, and support the vessel at sea, and the Defendant did not take measures such as taking measures for pollution response and measures for pollution response against the vessel.

Thus, the defendant at the same place on July 31, 2017 due to the above negligence, and the occurrence of an unsatisfy in diameter on the bottom of the ship at the same place, and thereby, discharged approximately 1,475 litress of the vessel low-water inside the ship to its sea at the same place.

③ The Defendant, like the above “(i) and (ii), flows out of the sea the oil, etc. on the said vessel.
