(hereinafter “C”) the production and installation works of 10 bits, among the production and installation works of the said group.

B. On October 27, 2014, C subcontracted to the Defendant the portion of the electrical construction among the production installation works of the 10-years, the said 10,000 rental (hereinafter “instant electrical construction”) to KRW 420,000,000 (excluding value-added tax).

On October 28, 2014, the Defendant re-subcontracted the instant construction project to the Plaintiff on October 28, 2014, and agreed to pay the construction cost of KRW 395 million in advance to the Plaintiff within 10 days after the contract was concluded, and the intermediate payment is in accordance with C’s payment terms, and the remainder shall be paid within 30 days after the issuance of the final supply completion certificate.

On January 12, 2012, the Plaintiff received a request from the Defendant for the construction of adding a dice to the MAB-15th SLBT BEM, the Defendant, and carried out the construction by additionally imposing an additional cost of KRW 6,600,000,000, in total of the material cost and construction cost of a mobile cable. On April 27, 2015 and May 12, 2015, the Plaintiff supplied the instant dice to the Hyundai item, and received a certificate of completion of delivery from the Hyundai item around that time.

The Plaintiff received KRW 86.9 million from the Defendant on November 5, 2014, KRW 50 million, KRW 26.9 million on November 6, 2014, and KRW 86.9 million on a total deposit, and KRW 65 million on February 17, 2015.

In addition, the Plaintiff received KRW 298,200,000,000 from C as the price for the instant construction, such as the Plaintiff received KRW 90,240,000 from C on April 17, 2015, KRW 4,240,000,000 from Apr. 30, 2015, and KRW 53,90,000 from modern items.
