1. Defendant (Counterclaim Plaintiff) receives KRW 55,000,000 from the Plaintiff (Counterclaim Defendant) at the same time.
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Facts of recognition;
A. 1) A Co., Ltd. (hereinafter “Non-Party Co., Ltd.”) was established for the purpose of real estate rental management business between the Plaintiff and the non-party Co., Ltd., and Non-Party D was the representative director of the non-party Co., Ltd.
The non-party company completed the registration of dissolution on February 21, 2018, and D was registered as a liquidator on the same day.
2) Meanwhile, on June 19, 2017, D completed the registration of an individual entrepreneur with the trade name “E” as “E” for the purpose of real estate leasing and management business, having the place of business as “F and G in the light name.”
3) On December 29, 2015, the Plaintiff entered into a sales consignment agreement with the Nonparty Company with respect to the instant building (hereinafter “A” in the following contract refers to Nonparty Company, and “B” refers to both the Plaintiff and the Plaintiff.
Article 1 (Purpose) of the Business Entrustment Contract
1. Eul shall entrust Gap with the business of this case as Gap.
2. The term "entrusted business" means all the affairs related to lease for goods sold by Eul, the payment of rents for rental guarantee period, the collection and management of deposits for lease, the lessee's physical color and selection, public relations for lease, management of rental contracts, and other affairs related to lease for such purposes;
Section 2 (Name II) The entrusted business shall be exercised in the name of B.
special agreement - A shall pay 650,000 won per month to Eul a security deposit (10,000,000) with the guarantee fee for the commission fee.
- A may have a difference between the above coverage amount and the amount at the time of a lease contract with a lessee.
The delegated person himself/herself (the plaintiff) confirms the fact of the lease contract with respect to the above goods (the above building in this case), such as the duties related to the lease, the payment of rent for the guarantee period, the collection and management of deposit money, the lessee's physical color and selection, the promotion of the lease, the management of the lease contract (form of the contract), etc., and is the non-party to the authority related to all matters related
