1. On August 10, 2012, the Defendant: (a) stated “D”, “E”, and “G” in the address column in the customer information column for application for subscription to a new service contract using a pentle in the store located in Nam-gu Incheon Metropolitan City, Nam-gu, Incheon; and (b) signed the name and issued the same as if he had been genuinely constituted to the employee in charge, who is unaware of the fact.

As a result, the Defendant, for the purpose of uttering, has forged a new service contract in the name of D, a private document related to rights and obligations, and has used it accordingly from that time.

8. By the day of 29.2, the service new contract, which is a private document with respect to rights and obligations, was forged at least eight times in total, as shown in Appendix 1, and exercised a forged service new contract.

2. The Defendant, at the date, time, place, and at the time, at the victim SK Telecom Co., Ltd., the Defendant issued a false statement to the effect that “If a mobile phone opens a mobile phone, he/she will faithfully pay the mobile phone price and the user fee.”

However, the defendant only intended to purchase a opened mobile phone without the consent of D and dispose of it to the seller of the mobile phone, and there was no intention or ability to pay the price even after the victim received the above mobile phone from the victim.

The Defendant, as seen above, received eight mobile phones equivalent to KRW 7,536,400 from the victim by deceiving the victim on a total of eight occasions, as shown in the attached Table 2 from around that time to around December 29 of the same month, including that the victim made a false statement to the victim and received one mobile phone equivalent to KRW 940,000 on the same day from the victim.
