3. Judgment on the defendant's defense
A. The gist of the Defendant’s assertion 1) The Plaintiff’s defense of offsetting the claim for liquidated damages was suspended in the absence of completion of each of the instant construction works. Accordingly, when calculating liquidated damages according to the rate of liquidated damages for the number of delayed days prescribed in each of the instant construction contracts, the Defendant’s compensation for delay is calculated based on the rate of liquidated damages for the number of delayed days prescribed in each of the instant construction contracts, the amount of KRW 77,760,00 (i.e., the construction cost of KRW 240,00,000 x the rate of liquidated damages x 0.3% x the number of delayed delay x 3,630,000 won (i.e., the construction price of KRW 222,000 x 0.3% x 55 days in lieu of the rate of liquidated damages x the Plaintiff’s claim for offset against the defect repair damages.
