For the reasons indicated in its holding, the lower court determined that it was guilty of fraud among the facts charged in the instant case, and rejected the grounds for appeal concerning mistake of facts that asserted a partnership contract or a comprehensive management right, etc.

The judgment below

Examining the reasoning in light of the evidence duly admitted, the lower court did not err in its judgment by violating logical and empirical rules and exceeding the bounds of the principle of free evaluation of evidence, or by misapprehending the legal doctrine on the intent of deception and deception in fraud, contrary to what is alleged in the grounds of appeal

Meanwhile, while the Defendant appealed to the entire judgment of the court below, the remaining facts charged are not indicated in the petition of appeal and the appellate brief.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
