For the reasons indicated in its reasoning, the lower court upheld the first instance judgment that acquitted the Defendant on the charge of this case on the ground that there was no proof of crime.

Even if examining the reasoning of the lower judgment based on the record, there is no error of mistake in the fact-finding due to a violation of the rules of evidence, as alleged in the grounds of appeal.
