The prosecution of this case is dismissed.
1. At around 14:00 on July 12, 2012, the Defendant: (a) committed assault, such as booming the victim’s breath and spathing the bat and spathing the head, on the ground that the victim C filed a criminal charge against the victim C from the investigation of the Namyang Police Station 20-15 South-dong Police Station; and (b) the first floor of the building, the victim C filed a criminal charge of embezzlement.
2. The above facts charged are crimes falling under Article 260(1) of the Criminal Act and cannot be prosecuted against the victim’s express intent under Article 260(3) of the Criminal Act. According to the records, the victim C expressed his/her wish not to punish the defendant in this court on April 15, 2013, after the institution of the instant indictment, so the prosecution of this case is dismissed in accordance with Article 327 subparag. 6 of the Criminal Procedure Act.
