Since then there is no significant change in circumstances to consider the sentencing of defendants.

Taking into account the defendant and the prosecutor’s respective petition of appeal, statement of grounds for appeal, and other various sentencing factors indicated in the records of trial, considering the circumstances alleged by the defendant and the prosecutor, the sentence of the court below is heavier or less severe than that of the defendant and the prosecutor.

Pursuant to Article 364 (5) of the Criminal Procedure Act, all appeals filed by the defendant and the prosecutor without oral proceedings shall be dismissed.
