1.The judgment of the first instance shall be modified as follows:
Defendant B Co., Ltd. shall be the Intervenor succeeding to the Plaintiff at KRW 68,979,622.
1. The facts below the underlying facts do not conflict between the parties, or may be acknowledged by taking account of the whole purport of the pleadings in each entry in Gap evidence 1 to 4, 11 to 15, Eul evidence 1, and Eul evidence 2-1 and 2.
The Defendants and D Co., Ltd. (hereinafter “debtor Co., Ltd.”)’s legal relationship 1) Debtor Co., Ltd. are the building F in Nam-gu Incheon Metropolitan City and 7 lots of land G (hereinafter “instant building”).
(2) On July 17, 2014, Defendant C entered into a lease agreement (hereinafter “instant lease agreement”) with Defendant B on part 9 to 13 floors above the ground among the instant building (hereinafter “instant real estate”) and the main contents thereof are as follows.
