1. Basic facts

The plaintiff performed design service at KRW 71.2 billion in price.
There are many kinds of chemical power design services such as 9, 10, 10, 1, 2, and 500 M W W with W W W, 3-6, 31-6, and 31-6.
The defendant is a company that performs engineering services in the field of chemical plant, power generation and energy, and industrial plant, and is a company that performs design services in the field of chemical plant B 1-4 units with 560 MW and C 7 and 8 units with 500 MW units in Korea, and is in competition with the plaintiff.
The Intervenor joining the Defendant (hereinafter referred to as the “ Intervenor”) is operating a power plant, such as a company established separately from the Korea Electric Power Corporation in 2001, Bitch power plant, Dratical power plant, etc.
B. The Plaintiff and the Intervenor, including the conclusion of a contract for design services of the thermal power plant D3 and 4, etc. of the Plaintiff and the Intervenor on February 28, 2003, established the basic design of the 870 MW C and D3, and 4 (the scheduled completion date of June, 2008 and March 2009) constructed by the Intervenor on February 28, 2003, including the establishment of the basic design of the facilities, calculation of major basic plans, preparation of basic drawings, execution of the basic design of soil construction costs, etc., are the detailed design based on the detailed basic design. The detailed design duties such as the establishment of the design plan and the system specifications, completion of installation of power plants and installation of equipment, completion of installation of machinery and electrical measurement and control, etc., are referred to as all the tasks supporting the construction of electric power plants in the process of purchase, construction, and operation of the power plant other than the service duties, including the relevant business operator’s comprehensive service report, driving report, preparation of design specifications, and construction work drawings, etc.
