The judgment below

In light of the evidence duly adopted by the court of first instance, the court below's determination that the charged facts of this case are guilty is just, and contrary to the allegations in the grounds of appeal, the court below did not err by misapprehending the legal principles as to "the establishment of medical institutions by non-medical persons" under Article 33 (2) of the Medical Service Act, or by misapprehending the legal principles as to "the establishment of medical institutions by non-medical persons".

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
