The Defendant, in the name of “I” in the first floor (F points) underground of Seongdong-gu Seoul building and the tenth floor (H points) of the Suwon-gu G building in Seongdong-gu Seoul Metropolitan Government, was operating the said restaurant, and was in the actual sales including cash sales while operating the said restaurant, and was in charge of identifying and managing cash revenues.

During that period, the Defendant reported the reduction of the sales amount received in cash by using the fact that the sales amount sold in cash is not well exposed to the source of source of source of source of source of source of source of source of source of income tax and value-added tax, and had a tax accountant who represents the above restaurant of a tax return report without providing the above report on the result of such events.

1. On May 31, 201, the Defendant evaded income tax of KRW 179,359,078, more than the amount of sales made on the basis of “exercise Report” when filing an income tax return in 2010 on May 31, 201, and then entered into an existing accounting program in an amount lower than the amount of sales made on the basis of “exercise Report”, and subsequently filed a report with the tax accountant in charge and filed a tax evasion of KRW 50,14,327 by fraud or other unlawful act, and subsequently, filed a report and filed a tax evasion of KRW 273,705,272 on four occasions, as shown in attached Table (1).

2. On October 25, 2010, the Defendant evaded the value-added tax of KRW 678,415,541, total amount of value-added tax over 15 times as indicated in the attached Table for Crimes, including the Defendant’s evasion of value-added tax 69,266,585,545 by reporting it to an existing accounting program at a lower amount than the sales amount written on the basis of “the event report” when filing a value-added tax return for the second half-year period of 2010.
