The prosecutor's appeal is dismissed.
1. The summary of the grounds for appeal (ten months of imprisonment and two years of suspended execution, etc.) of the lower court is deemed to be too unhued and unfair;
2. In full view of the following factors: (a) the Defendant’s Defendant’s deep reflects the Defendant’s life in prison for approximately forty (40) days; (b) the primary offender was the Defendant’s age, character and conduct, environment; (c) the developments and result of the instant crime; and (d) the circumstances behind the instant case’s argument, even if considering the circumstances of the prosecutor’s assertion, the lower court’s punishment is too unjustifiable and unreasonable.
3. Accordingly, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the appeal is without merit. It is so decided as per Disposition.
