The prosecutor's appeal is dismissed.
1. The gist of the grounds of appeal is that witness F and victim E’s statement, which are evidence corresponding to the facts charged of this case, have considerable credibility, so the facts charged of this case can be fully found guilty.
Nevertheless, the lower court erred by misapprehending the facts and adversely affecting the conclusion of the judgment, which acquitted the Defendant of the facts charged.
2. Determination
A. The summary of the facts charged in this case is that the Defendant is a driver of Mati Vehicle, and on October 22, 2012, 12:10, the Defendant suffered injury, such as catal fats, etc. requiring two-hour medical treatment for the driver E in front of the 1153-5-dong-dong-dong-dong-gu, Ansan-si, and the left-hand turn-hand turn-hand-hand-hand-hand-hand-hand-hand-hand-hand-hand-hand-hand-hand-hand-hand-hand-hand-hand-hand-oned-on-hand-on-on-hand-on-hand-on-hand-on-hand-on-hand-on-hand-on-hand-on-hand-on-hand-on-hand-on-
B. The lower court’s judgment: (a) the statement in G investigation agency is the statement that (b) the witness G testified that he made a false statement in the direction of the victim’s vehicle, and (c) according to F’s investigation agency and the statement in the court of the lower court, F did not directly witness the instant accident; (d) the vehicle behind the instant accident was driven by the vehicle in the direction of the victim’s vehicle at the intersection where the instant accident occurred; and (e) the signal at the time when the instant accident occurred when the vehicle was changed to one lane and passed through the intersection was sent directly to the direction of the victim’s vehicle at the time of the instant accident; and (e) the statement in F alone is insufficient to recognize that the Defendant’s vehicle was stopped at the time of the instant accident and that the traffic at the time of the instant accident was directly sent to the victim’s vehicle at the intersection.
