However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

On November 12, 2018, the Defendant: (a) reported the victim D, who is a disabled person of Grade III with intellectual disability, before the “C convenience store” in the racing-si, Si; and (b) sought to find out the phone number of the victim through the division of conversations with the victim’s name.

1. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes and Violation of the Act on the Protection of Children and Juveniles against Sexual Abuse;

A. 나. 2018. 11. 18.자 범행 피고인은 2018. 11. 18. 08:40경 위 편의점 앞으로 피해자를 불러내어, 근처에 있는 상호 불상의 원룸 앞으로 피해자를 데리고 간 후, 손을 피해자의 상의 안으로 집어넣어 양쪽 가슴을 만지고, 재차 피고인의 손을 피해자의 팬티 안으로 집어넣어 엉덩이를 만진 후, 피고인의 바지와 속옷을 내리고 피해자에게 ‘만져 달라.’고 하였으나 피해자가 ‘싫다.’고 거절하자, 피고인의 입으로 피해자의 혀를 깨물거나 핥고 피해자 앞에서 스스로 자위를 하였다.

As a result, the Defendant committed an indecent act on the part of a child or juvenile who has a mental disability twice.
