Reasons

1. Basic facts

A. In order to newly construct a new house on June 17, 2014, the Plaintiff completed the registration of ownership transfer with respect to the land of 641 square meters in Gyeonggi-do, Busan-gun, Busan-do (hereinafter “instant Plaintiff”). The Plaintiff also stated that the registration of ownership transfer was completed with respect to the land of this case, and that the land of 740 square meters (hereinafter “instant F”) located in the name of F on the land cadastre, i.e., the attached Table 3 was indicated.

B. The G road in the Gyeong-gun, Chungcheongnam-gun, Busan (hereinafter referred to as the “instant road”) was a public road, as shown in the attached Table 3, which is a part of the original drawing, adjacent to the boundary of the instant F land, and was constructed by linking the instant land to the instant land for access to the Plaintiff’s land (not to be specified at least 1.8m through 3m). However, the current road is over the right side of the road on the cadastral map (hereinafter referred to as the “H land”) and the building on its ground (hereinafter referred to as the “side direction”) depending on the attached Table 3 appraisal map. The current state of the road’s boundary is adjacent to the boundary of the instant F land. The actual right side of the affected part constitutes a cadastral map with a high fence and thus, it is practically impossible to restore the road according to the boundary, and the shape of the road in this case’s shape is at the left-hand side.

다. 이 사건 ㈏부분 토지는 이 사건 도로의 현황과 이 사건 F 토지 중 일부를 포함하고 있는데, 이 사건 ㈏부분 토지는 이 사건 원고 토지로 진입하기 위한 통행로로서 사용되어 왔고 그 현황 역시 도로로서의 형상 및 기능을 갖추고 있다. 라.

원고와 F 사이에 2017. 6. 8. “F은 원고에게 이 사건 F 토지 중 이 사건 ㈏부분 토지에 관하여 통행권이 있음을 확인한다”라는 판결이 선고되었고 F에 대하여 공시송달로...
