The Defendant is a driver of the D Village bus operated in error transportation (hereinafter “o-traffic”) by the Defendant.

On the other hand, C was elected at the 6th local election of Dong local council members of Guro-gu Seoul Metropolitan Government on June 4, 2014 as a candidate for H political party belonging to the E constituency (F and G) in the 6th local election of Dong local council members of Seoul Metropolitan Government.

1. No one who violates the Public Official Election Act shall distribute, post, spread, play, or run an advertisement, letter of personnel management, poster, photograph, document, picture, picture, picture, printed matter, printed matter, recording, video tape, and others similar thereto, which include the contents supporting, recommending, or opposing a political party or candidate's name, or which indicate the name of a political party or candidate's name, in an effort to influence an election from 180 days before the election day to the election day;

Nevertheless, around June 1, 2014, the Defendant posted a name tag for the election campaign C at the D Village bus hold of Defendant's driving D's D's D's village bus in order to advertise C to the persons with the right to use the village bus for the operation of error transportation, and 5 of the above name box at the K Village bus's glass, which is another village bus for the operation of error transportation, and 1 of the above name box at the glass hold of L's village bus, respectively, so that they can be seen by the persons with the right to use the above constituency.

2. On June 1, 2014, at around 18:20 on June 1, 2014, the victim M (n, 42 years of age), N (n, 54 years of age) who is a member of the Guro-gu Election Commission Fair Election Commission’s Fair Election Support Group, visited the above village bus with the above village bus stops to confirm that the above village bus is displayed as stated in the preceding paragraph, and after obtaining the consent of the operator of the above village bus such as the defendant, etc., the above village bus stops and the defendant et al., the above name tag’s photo attached to the above village bus and its glass.

The defendant operated a bus route with D Village bus around 18:40 on June 1, 2014 and thereafter the bus route is operated.
