A. On August 29, 2015, the Plaintiff entered into a new building construction contract (hereinafter “instant construction contract”) with Defendant LAC Co., Ltd. (hereinafter “Defendant Co., Ltd”).

The name of a construction project: The date of commencement of the new construction project for nearby and multi-households: The date of Kimpo-si C: the date of completion of the project on October 12, 2015: the contract amount: 400,000,000 won (excluding value-added tax) for delay on December 30, 2015: 1/1,000 interest rate for delay: 1/1,000

B. According to the instant construction contract, the Defendant Company had difficulty in raising the third floor building of reinforced concrete structure (hereinafter “instant building”) on the ground of Kimpo-si, Kimpo-si, and delayed the completion of the construction of the said building. Ultimately, the Plaintiff made an agreement on April 30, 2016 to pay the construction cost directly to the subcontractor of the Defendant Company.

The settlement amount of the construction of this case shall be KRW 400,000.

The defendant company confirms that all construction costs have been included in the above construction costs until the settlement of accounts, and the defendant company does not raise any objection including civil and criminal charges.

The defendant company guarantees that there is no wage, material, food, etc. to be borne in connection with the above project, and if the defendant company claims against the plaintiff with respect to the unpaid payment of the defendant company, the defendant company shall be liable and settled.

The settlement of completed amount shall be made until May 15, 2016.

The defendant company shall be fully responsible for the plaintiff's damage caused by the process until the completion date.

The defendant company shall pay the penalty for delay to the plaintiff from the scheduled date of completion of the construction to the completion date.

C. The Kimpo-si market approved the use of the new building of this case on July 13, 2016.

Defendant B, as the head of the site of the Defendant Company, has carried out the overall construction of the instant construction contract at the construction site of the instant construction contract, and performed on February 28, 2016.
