1. On January 26, 2011, the Defendant entered the Plaintiffs in the separate claim amount sheet in the separate claim amount sheet in the separate claim amount sheet in attached Form 2, and with respect thereto.

Basic Facts

The defendant is a company engaged in the development of power resources, etc., and the plaintiffs were employed as the first class or the third class employee belonging to the defendant and were retired from office.

Article 47 (Mandatory Retirement) (1) of the collective agreement of December 30, 2009 (excluding the executive employee) of the collective agreement of December 30, 2009 shall be 58 years old.

Provided, That where an employee selects a wage peak system, the retirement age shall be 60 years of age.

On December 30, 2009, the Defendant concluded a collective agreement with the Korea Electric Power Workers' Union (hereinafter referred to as the "Electric Power Workers' Union") composed of not more than four classes of employees and a majority of all employees of the Defendant (hereinafter referred to as the "electric power union") and agreed to provide the following with regard to "the wage peak system for extension of retirement age (the system that pays the wage at a certain rate from a certain point before the commencement of the extension of retirement age, instead of extending retirement age for a certain period, by reducing the specified rate of the specified wage from a certain point before the extension of retirement

On June 30, 2010, the decision of the board of directors made on June 30, 2010, the Defendant made a decision that “the current rate of wage reduction is adjusted upward, and the enforcement is made for the executive officers of at least three classes,” which was presented as agenda by holding a board of directors on June 30, 2010.”

Article 43 (Reduction of Wages) Wages of an employee subject to the wage peak system shall be paid by reducing a fixed rate each year on the basis of a fixed rate of wages.

Retirement allowances for employees subject to the wage peak system under Article 44 (Interim Settlement of Retirement Allowances) shall be interim settlement in accordance with Article 27 of the Regulations before the application of the wage peak system, and interim settlement shall be made when changing the rate of wages thereafter.

[Enforcement Rule of the Annual Salary Regulations] Article 65 (Standard Date of Application) reduces wages subject to the wage reduction system.
