A defendant shall be punished by imprisonment for six months.
However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime
The defendant of "2018 Highest 905" is the representative of the manufacturing chain D in Gwangju City, who ordinarily employs nine workers.
1. When a worker dies or retires, an employer in violation of the Labor Standards Act shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;
Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.
Nevertheless, the Defendant did not pay KRW 5,521,173 of the E’s wages, which he/she worked in the above workplace from March 1, 2015 to February 1, 2016, within 14 days from the date of his/her retirement, and did not pay KRW 59,525,626 of the total wages of four workers within 14 days from the date of his/her retirement, as shown in the list of crimes in the attached crime list.
2. An employer who violates the Guarantee of Retirement Benefits of a worker shall pay a retirement allowance within fourteen days after the ground for such payment occurred, in case where the worker retires; and
Provided, That the payment date may be extended by mutual agreement between the parties in extenuating circumstances.
Nevertheless, the Defendant did not pay KRW 5,615,342 of F's retirement pay from March 1, 2015 to April 30, 2016 at the same place of business within 14 days from the date of retirement.
The defendant of "2018 Highest 1865" is a user who operates D of a manufacturer in Gwangju City C.
