On May 17, 2017, the Defendant was issued a summary order of KRW 5 million for a violation of the Road Traffic Act (driving) in the Changwon District Court’s branch court’s jurisdiction over the Defendant, and on September 20, 2018, issued a summary order of KRW 3 million for the same crime in the Busan District Court’s branch court.

The Defendant is a person engaging in driving a Bran XG car.

On April 22, 2020, the Defendant, without obtaining a driver's license at around 18:20 on April 18, 2020, driven the above vehicle while it is difficult to drive the vehicle normally due to influence of alcohol at a level of 0.138% under the influence of alcohol, and continued to drive the said vehicle at the direction of four-lanes in front of D in Busan, Seodo-gu C at the intersection of Seodo-gu, Busan, along four-lanes from the intersection of Seodo-gu to the intersection of Seodo-gu.

In such cases, a person engaged in driving of a motor vehicle has a duty of care to prevent accidents in advance by safely driving the motor vehicle, such as reporting the traffic situation well and accurately operating the steering direction and brake system.

그럼에도 불구하고 피고인은 음주의 영향으로 정상적인 운전이 곤란한 상태에서 이를 게을리 한 채 전방 주시를 태만히 한 과실로 피고인의 진행방향 전방에서 정차하고 있던 피해자 E(남, 25세)이 운전하는 F K3 승용차의 뒷범퍼를 피고인의 승용차의 앞범퍼로 들이받고, 이로 인하여 위 K3 차량이 앞으로 튕겨 나가 그 앞에서 정차하고 있던 피해자 G(남, 50세)가 운전하는 H 싼타페 승용차의 뒷범퍼를 들이받게 하고, 이로 인하여 위 싼타페 승용차가 앞으로 튕겨 나가 그 앞에 정차하고 있던 피해자 I(남, 39세)이 운전하는 J 모하비 승용차의 뒷범퍼를 들이받게 하였다.
