Defendant B, on June 13, 2018, registered as a preliminary candidate on March 2, 2018 in the election of City Council Members of the 7th City/Do local council (D constituency) nationwide, which was implemented on March 13, 2018. On March 16, 2018, Defendant B filed an application for change to E constituency. Around that time, Defendant B filed an application for change to E constituency on March 16, 2018 with the F Party G City Council member for an interview on April 5, 2018, but went away from Gongcheon on May 4, 2018.

Defendant

A is a person who was elected by going to the election of the 7th City/Do Provincial Council Members (H constituency) at the 7th National Assembly Members nationwide held on June 13, 2018.

Criminal facts

No one shall offer, declare an intention of offering, or promise to offer money, valuables, other property profits, or public or private positions, or shall receive the offer or accept the declaration of intention of offering concerning the recommendation of a specific person as a candidate by a political party.

1. On April 16, 2018, Defendant B and Defendant B provided Defendant B with KRW 20 million in cash within the Jco or passenger car of Defendant B of the first floor parking lot in front of the I building (F Party G party office location) (hereinafter “F party G party office”), and Defendant A provided Defendant B with “the F party office in relation to the election of members of the 7th City/Si Council in the 7th City/Do local election,” and Defendant A received the said office.

As a result, Defendant B provided money in relation to the recommendation of a specific person as a candidate by a political party, and Defendant A received the offer.

2. Defendant B: (a) around April 15, 2018, at the parking lot of the 1st floor underground of the K Building (the location of office of a National Assembly member L (F Party G Party Chairperson) (the office of a National Assembly member L), Defendant B provided 30-year sirens for two-year sirens with the market price of KRW 1 million, 300,000,000, in order to obtain assistance from a National Assembly member M. as stated in the foregoing 1.

As a result, the defendant provided money in relation to the recommendation of a specific person as a candidate by a political party.
