1.The judgment of the first instance shall be modified as follows:
The defendant's Daegu High Court Decision on July 26, 2012.
1. Basic facts
A. The side Switzerland Co., Ltd. (hereinafter “the side Switzerland”) newly constructed the real estate listed in paragraph 7 of the attached Table No. 7 (hereinafter “instant building”) on the ground of the real estate listed in paragraphs 1 through 6 of the attached Table No. 1 (hereinafter “instant site”).
On October 2006, UNND Co., Ltd. (hereinafter referred to as "IDD") purchased the building of this case from the side Switzerland and acquired its ownership.
On June 9, 2008, the Defendant awarded the instant land in the voluntary auction procedure for the instant land on June 9, 2008, and acquired the ownership of the instant land by full payment of the price on June 24, 2008.
나. 피고는 2008. 7. 4. 휴엔휴를 상대로 대구지방법원 2008가합7271호로 이 사건 건물의 철거, 이 사건 대지의 인도 및 부당이득금의 반환을 구하는 소를 제기하였고, 위 법원은 2009. 9. 30. '휴엔휴는 피고에게 이 사건 건물과 별지 도면 표시 A, B, C, D, E, F, G, H, I의 각 점을 차례로 연결한 ㈏부분 담장(이하 ‘이 사건 담장’이라 한다)을 철거하고 이 사건 대지를 인도하며, 피고가 소유권을 취득한 2008. 6. 24.부터 이 사건 대지의 인도의무를 완료할 때까지 이 사건 대지의 점유사용으로 인한 부당이득금으로 월 4,058,000원의 비율로 계산한 돈을 지급하라'는 전부 승소판결을 선고하였다.
C. Around February 18, 2011, the Court dismissed the part of the claim for delivery of the instant site and the removal of the above ground buildings on the ground that 395 square meters of the instant site had been acquired legal superficies for the said 395 square meters of the instant site among the instant site on the grounds that YND had been dissatisfied with it and appealed as 2009Na8483, and the said court paid rent calculated by the ratio of KRW 4,058,00 per month from June 24, 2008 to the completion date of delivery of the said 3,548 square meters of the instant site, and the said portion is dismissed.
