However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

피고인은 2015. 9. 4. 10:10 경 수원시 팔달구 C에 있는 'D' 버스 정류장에서 강남 역으로 가기 위해 E 버스에 승차하여, 눈을 감고 있는 피해자 F( 여, 23세) 의 옆 자리에 앉았고, 위 버스가 같은 날 10:32 경 성남시 분당구 G에 있는 ‘H ’에 진입하기 직전, 휴대폰을 쥔 채 왼쪽 손가락으로 피해자의 오른쪽 허벅지 부위를 쓸어 올리듯이 만져 추행하였다.

주장 하나, 이 법원이 적법하게 채택, 조사한 증거들에 의하여 인정되는 다음과 같은 사정, 즉 피해자는 수사기관 및 이 법정에서 ‘ 피고인이 왼손에 핸드폰을 쥔 채 한 손가락을 이용하여 피해자의 무릎 윗부분부터 허벅지 중간 부분까지, 허벅지의 측면이 아닌 윗부분을 쓸어 올렸다.

“The statement is made specifically and consistently to the purport that the victim made a statement, and the victim did not have any specific reason to believe the defendant, and the defendant merely made a reliable statement, and the defendant argued that the part of the bridge of the victim by the number of times in the process of drilling the paper buck.
