1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
1. Circumstances leading to the dispute of this case;
A. The Plaintiff is operating a land mining fish plantation (hereinafter “instant fish plantation”) in the 261-ro, e.g., the e., the e., the e., the e.g., the e.
The plaintiff and the defendant conclude a contract for the safety management of the plaintiff's electrical equipment on their behalf as follows:
The location of electric installations: 261 Electric facility capacity: 30KW, voltage 22900 V contract period: Article 1 of the Act on March 1, 2015 to February 28, 2017. The Defendant shall dispatch the Plaintiff’s electric facility 1 through twice a month to the Plaintiff’s electric safety manager to check in good faith.
Article 4. The plaintiff must notify the defendant of the detailed contents without delay in the following cases:
1) Upon receipt of notice under Article 4(1) through (3) of the Act, the Defendant shall promptly dispatch its electrical safety supervisor to the Plaintiff’s site to take emergency measures or seek advice on the planning work in the event that any defect or other electrical equipment has occurred or is likely to occur. 2) In the event of planning, construction or alteration work, 3) the name of the workplace, the name of the representative, the place of installation and the type of business are to be changed, and the Defendant shall promptly dispatch its electrical safety supervisor to the Plaintiff’s site to take emergency measures or seek advice on the planning work.
B. On March 1, 2015, the Plaintiff concluded a contract on vicarious execution of the safety management of electric installations with the Defendant who performs the duty of safety management of electric installations in the instant aquaculture, as follows:
(B) No. 1, 3 (hereinafter referred to as “instant contract”).
In the instant model, electric motors installed in around 05:0 on May 5, 2015 in order to supply seawater to a fish farm (hereinafter “instant electric motor”) are damaged by typ and thereby electricity is temporarily electricity at the instant model.
