The prosecution of this case is dismissed.
1. On March 9, 2017, the Defendant: (a) committed assault against the victim C (28) who is a parking management employee in front of the former parking lot in Ansan-si around 17:17; (b) during the parking problems with the victim C (28:3); (c) in the course of being pushed in with the victim C (28:3), the victim’s arms are tightly sealed; and (d) the victim’s arms are shakened into the bottom.
2. Grounds for dismissing the public prosecution;
(a) Crimes of non-violation of intention (Article 260 (3) of the Criminal Act);
B. On April 10, 2017, following the institution of public prosecution of the instant case, the victim’s expression of intention not to punish the victim.
C. Judgment dismissing public prosecution (Article 327 subparag. 6 of the Criminal Procedure Act)
