The prosecution of this case is dismissed.
Reasons
1. Around 17:30 on July 10, 2020, the Defendant assaulted the victim’s face at one time on drinking on the ground that the victim C (son and 6 years of age) play in front of the B apartment playground in Seoul Special Metropolitan City, Nowon-gu, Seoul, and on the ground that he was disabled.
2. Determination
(a) Applicable provisions of Acts: Article 260 (1) of the Criminal Act;
(b) Crimes of non-compliance with an intention (Article 260 (3) of the Criminal Act);
C. Indication of the victim as not to be punished after the prosecution of this case
(d) Judgment dismissing public prosecution (Article 327 subparagraph 6 of the Criminal Procedure Act);
