A. Since August 23, 2004, the land of this case was owned by the Plaintiff. The Defendant installed and occupied the water supply and drainage facilities (hereinafter “instant water supply and drainage facilities”) under the ground as follows.

① From April 22, 2011, on the underground surface of the Section (a), (b), (c), and (d) of the attached appraisal map, the water supply pipes and the Section (e) laid the water supply log. Of them, the area of the Section (a) is 1.63m2, the area of the Section (b) is 4.18m2, the area of the Section (c) is 0.17m2, the area of the Section (d) is 0.17m2, the area of the Section (d) is 11.36m2,

(상수도 시설 전체 면적 합계는 19.59㎡). ② 2014. 7. 14.부터 별지 감정도 표시 ⓕ부분 지하에 오수관, ⓖ부분 지하에 오수 맨홀을 매설하였는데, 그중 ⓕ부분 면적은 1.65㎡, ⓖ부분 면적은 0.5㎡이다

The rent for using the portion of the instant land from April 22, 201 (the date of installation of waterworks facilities) to 2.15 square meters (the area of sewerage facilities) with respect to the underground part of 19.59 square meters (the date of installation of waterworks facilities) among the instant land, from July 14, 2014 (the date of installation of sewerage facilities) to February 21, 2018, respectively, is 292,000 won in total, and the rent thereafter with respect to the total of 21.74 square meters of underground area is 48,000 won per annum.

2. Determination

가. 임료 상당 부당이득 반환에 관하여 위 인정사실에 의하면, 피고는 이 사건 토지 중 ⓐ 내지 ⓖ부분 합계 면적 21.74㎡ 지하에 이 사건 상하수도 시설을 설치하여 그 부분 토지를 점유하고 있고, 달리 점유할 권원을 증명하지 못하는 이상 소유자인 원고에 대하여 그 점유로 인한 부당이득을 반환할 의무가 있다.

Therefore, the defendant is to install the water supply and drainage facilities of this case to the plaintiff.
