The prosecution of this case is dismissed.
Reasons
1. 공소사실의 요지 피고인은 2016. 2. 11. 대구 달서구 B에 있는 이혼한 전처의 집에서 인터넷 포털사이트 ‘ 네이버 지식인 ’에 접속한 후, 피해자 C이 운영하는 ‘D’ 식당에 관하여 ‘ 대구 다사 D 절대 시켜 먹지 마세요’ 라는 제목으로 ‘ 월급 깎는 생양 아치, 중자도 모르는 ㄱ ㅐ ㅅ ㄲ' 라는 글을 작성, 게시하여 공연히 피해자를 모욕하였다.
