A defendant shall be punished by imprisonment for one year.
14 million won shall be additionally collected from the defendant.
Punishment of the crime
1. Violation of the Game Industry Promotion Act;
A. From August 31, 2011 to September 23, 2011, the Defendant violated the Game Industry Promotion Act in D Gameland: (a) registered a game providing business under the name of F in the name of “D Gameland” from the second floor office of the building E in Busan Dong-gu to the name of “D Gameland; (b) unlike the contents of the rating classification, the Defendant employed F and G as the chief of management department; and (c) provided customers with automatic games without a user’s manipulation; and (d) exchanged the books, which they acquired through the game practice, to provide customers for use by automatically altering the example and performance of the game; and (e) exchange them with KRW 4,500,00 after deducting 50 won per commission for each game.
As a result, the defendant, in collusion with F and G, provided customers with contents different from the contents of the rating classification, and exchanged results obtained through the use of game products.
B. From November 2, 2011 to December 4, 2011, the Defendant violated the Game Industry Promotion Act in H Gameland registered a game providing business by lending the name of G from the second floor office of the building E in Busan-gu to the name of “H Gameland”, and then employing F and G as the managing director, and installing 40 game flags indicating “F and G” on the outer side, and installing a game dispute over the game which does not receive a grade within the said scope and inserting a certain amount of money to customers, if a certain score is given, and a certain score is deducted for each game to stop, and if the picture corresponds to a certain direction, a certain score is given on the screen and the premiums are charged depending on the points, and the fee per page, which is the free gift acquired by customers by running the game, was deducted to KRW 4,500 won.
Accordingly, the defendant was not rated in collusion with F and G.
