The prosecution of this case is dismissed.
1. The Defendant, as the representative D of a medical corporation located in Gangnam-si C, is an employer who runs a medical business using 40 regular workers.
When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred.
Provided, That the date of payment may be extended by an agreement between the parties in extenuating circumstances.
Nevertheless, the Defendant did not pay the total of KRW 27,80,000 as wages of KRW 15,30,000 on November 1, 2013, which was worked from October 1, 2013 to December 31, 2013 at the above workplace, and KRW 27,80,000 on December 2, 2013, without any agreement on extension of the payment date, within 14 days from the date of retirement.
