All of the instant lawsuits are dismissed.

Litigation costs shall be borne by the plaintiff.

Reasons

1. Basic facts

A. The Plaintiff is a corporation that runs a housing construction business.

The defendants are the parties against whom the preceding lawsuit is lost and their successors.

B. The process of the preceding lawsuit (such as filing for registration of transfer of ownership) Busan Suwon-gu (hereinafter “Yyoung-gu”) was used as a fishery harbor by the fishing village fraternity B around June 14, 2002.

C When performing reclamation works on public waters under paragraph (c), the construction of active fish plates on a scale of 800 square meters in total floor area of the 1st and second floor above the ground (including the basic construction that can extend three floors in the future; hereinafter “the building of this case”) was agreed to provide 197 fishing village members as compensation for fishing losses incurred by the construction work.

2) The buyers who purchased the aforementioned fishing village fraternitys or their shares (hereinafter collectively referred to as the “owners of equity interests”) completed the registration of transfer of ownership in the future of the above fishing village fraternity members with respect to each of the 1/197 shares of the first and the second above ground floors of the instant building, and agreed that the members of the fishing village fraternity divided each of the stores and completed the registration of transfer of ownership in the divided ownership.

3) On March 23, 2006, equity holders constituted a “D active fish direct sales center promotion committee” (hereinafter “promotion committee”) and delegated the new construction of active fish direct sales center to efficiently deal with the problems of new construction and extension of active fish direct sales center.

4) On March 20, 2007, the promotion committee entered into the following sales contract (hereinafter “the sales contract in this case”) with the content of selling the extended portion of land from the Plaintiff and the active fish direct sales outlet 2 to 3, and from 7,000 to 5,000,000 won (an amount of KRW 300,000 on the date of the contract, the remaining amount of KRW 5,450,000,000,000,000,000 on the date of the contract, and the written consent for extension from all equity owners and all documents to be transferred in the name of the buyer.
