A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.
Punishment of the crime
No one shall invite an alien by improper means, such as a false statement of fact or a false fidelity guarantee, to allow the alien to enter the Republic of Korea.
1. In around August 11, 2013, the Defendant committed the crime of false invitation using the business operator under the name of the Defendant: (a) after receiving a proposal from E to register the business operator with the name of “F” in the name of the Defendant, “F”; (b) after obtaining the personal information of E, who wishes to be employed in Korea from E, prepares a false letter of invitation as if he/she is the F, and then deliver it to G via E; (c) on August 11, 2014, he/she presented a false letter of invitation from the Incheon International Airport entry inspection site located at the Incheon International Airport at the airport via Jung-gu Incheon, Incheon, Incheon, to a public official in charge of entry inspection at that place, presented the above false letter of invitation to enter Korea.
Accordingly, in collusion with E, the Defendant invited foreigners in an unlawful way in order to allow them to enter G, and obstructed the legitimate performance of duties in relation to the entry inspection by public officials in charge by deceptive means, as described in [Attachment] Nos. 1 through 3, from around that time to August 22, 2014, the Defendant invited foreigners in an unlawful way to enter the Republic of Korea, and interfered with the legitimate performance of duties in relation to the entry inspection by public officials in charge by deceptive means in total three times.
2. The Defendant, in the course of falsely inviting E with another person’s business proprietor, becomes aware of the E in the course of falsely inviting E, and received a list of Egypters who wish to be employed in Korea from the Egypt nationality (hereinafter “H”). On or around 2015, I received a list of Egypters who falsely inviting foreigners to enter Korea.
