주식회사 B은 인천 부평구 G, 203호에서 건축 공사업 등을 목적으로 설립된 상시 근로자 약 7명을 두고 있는 법인 이자 사건 외 H로부터 충북 충주시 I 공동주택( ‘J’) 신축공사를 도급 받은 법인이고, 피고인 C은 주식회사 B 소속 직원으로 위 신축공사 현장의 현장 소장 겸 안전 총괄책임자이며, 피고인 A은 ‘K’ 라는 상호로 샷 시공사 등에 종사하는 사람으로 주식회사 B로부터 위 공동주택 신축공사 중 샷 시공사를 하도급 받은 사람이고, 피고인 D은 ‘L’ 라는 상호로 고소작업 대 장착 차량 (M) 을 운행하는 사람이며, 피해자 N은 ‘K’ 소속 직원이다.

1. 피고인 A, C, D의 업무 상과 실 치사 및 피고인 A, C의 산업안전 보건법위반 피고인 A은 피해자 등과 함께 충주시 I 공동주택 신축공사 중 샷 시공사를 공사대금 93,500,000원에 주식회사 B로부터 하도급 받았고, 이를 위해 2015. 2. 2. 피고인 D에게 건물 외벽에 설치할 샷 시를 운반할 고소작업 대 장착 차량을 운전해 줄 것을 요청하였다.

Accordingly, at around 12:37 on February 3, 2015, Defendant D driven a vehicle installed with the above MM work unit at the I Multi-Family Housing Construction site in Chungcheongnam-si, and moved the victim to the workplace of the complaint work unit and the 401 unit of the said new building to the 6th floor near the above 401 unit of new building. After confirming that K employees, including the victim, completed the installation of balcony rail, the vehicle was cut off from the outer wall of the building before entering the complaint work unit.

At the time, the construction site was located in front of a high voltage charging, and part of the vehicle equipped with a high voltage, or part of the worker on work, in the process of the operation, was a place where the high voltage accident is likely to occur if the body of the worker on work is in contact with the high voltage. Thus, the Defendant D, who is engaged in driving of the high voltage, is also the accused.
