The prosecution of this case is dismissed.
1. On September 17, 2015, the Defendant: (a) around 22:50 on September 17, 2015, at “Curel” located in Songpa-gu Seoul, Songpa-gu, Seoul, assaulted the victim D (30 h) who is an employee and on accommodation expenses due to the victim’s body; and (b) was committed by putting the victim’s leg up on the floor by breaking it over the floor.
2. Determination
(a) Crimes of non-violation of intention (Article 260(3) and (1) of the Criminal Act);
B. On January 13, 2016, the victim D’s expression of intention not to punish him/her, as stated in an application for non-criminal punishment, after the instant indictment was instituted.
C. Judgment dismissing public prosecution (Article 327 subparag. 6 of the Criminal Procedure Act)
