1. On May 18, 201, the Defendant made a false statement to the victim AV by phoneing the victim AV at a non-permanent place, stating that “I would make payment without molding one week after lending KRW 7.6 million to the victim.”

However, in fact, the defendant received money from other persons at the time and used it as operating expenses of the Ka Center, and even if he/she borrowed money from the victim without any specific property, he/she did not have any intent or ability to repay it.

The defendant deceivings the victim as above and obtained 7.6 million won from the victim to receive 7.6 million won as the loan from the victim on the same day.

2. 피고인은 2011. 9. 9. 경 서울 성동구 AW에 있는 피고인이 운영하는 카센터에서 피해자 AV에게 “ 서울지역 SK 네트 웍스 수입 차 부품 대리점 판권을 인수하여 사업을 운영하고 있는데 급히 돈이 필요하다.

The loan made a false statement to "I will make a repayment without money in advance after one month from the lending of money."

그러나 사실 피고인은 당시 SK 네트 웍스 수입 차 부품 대리점 판권을 인수한 사실이 없었고, 다른 사람들 로부터 돈을 받아 운영하는 사업체의 운영비로 사용하는 등 재정이 좋지 않은 상황이었으며, 별다른 재산이 없어 피해 자로부터 돈을 빌리더라도 이를 갚을 의사나 능력이 없었다.

The defendant deceivings the victim as above and obtained 72,40,000 won from the victim as the loan money on the same day and acquired it by deceit.
