공사대금
1. The Defendant shall pay to the Plaintiff KRW 49,60,000 and the interest rate of KRW 15% per annum from June 15, 2017 to the day of full payment.
On November 10, 2016, among “B-built construction works” executed by the Defendant, the Plaintiff was awarded a subcontract for the construction cost of KRW 61,600,000 (including value-added tax) and the construction period of November 10, 2016 to November 30, 2016. There is no dispute over the fact that the Defendant paid KRW 12,00,000,000 out of the construction cost.
The Defendant is obligated to pay the Plaintiff KRW 49,600,000 (=61,600,000 - 12,000,000) and damages for delay calculated at the rate of 15% per annum prescribed by the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings from June 15, 2017 following the delivery of the complaint of this case to the date of full payment, as sought by the Plaintiff.
