A defendant shall be punished by imprisonment for not less than one year and six months.
The defendant is a defrauded who is an applicant for compensation with 11,230,000 won.
Punishment of the crime
1. On April 28, 2020, the victim F was sent a text message to the victim F that “the victim F may receive a low interest rate substitute loan” at a place where the victim F cannot be identified.
On the same day, the person whose name was the victim who reported and contacted the above text message as of the same day, was able to borrow up to KRW 25 million at a low interest rate of 8.9% as his employee of the lending company. However, G Bank has a loan of KRW 8 million, which was granted by G Bank, and the application for a loan again is in violation of the terms and conditions of the loan, and is therefore in breach of the terms and conditions of the loan, and thus, he/she is the bad credit holder. In addition, if the account transfer is made, he/she will be the bad credit holder, and thus, he/she will be directly exempted the employees of G Bank in cash.”
However, in fact, the person who is not a member of the lending company was not a member of the lending company, and was thought to acquire money from the beginning for the purpose of lending.
On April 28, 2020, the name-free person ordered another name-free person to receive KRW 8 million in cash from the victim in the latter part of the I located in the North-gu, Gwangju, North-gu, Gwangju on April 28, 2020.
On April 29, 2020, the name-freeist continued to call again to the victim and make a deposit as if he/she is K employee of the J bank. In doing so, he/she stated, “The applicant sought to pay the loan amounting to KRW 25 million, which has been approved by L Bank, and in the past, he/she has contracted the violation of the loan amounting to KRW 10 million. The loan amounting to KRW 10 million will be paid in cash.”
On April 29, 2020, the Defendant: (a) deposited money from an unqualified person on the A.M.; (b) deposited money to a destination using public transportation in cash at all times; (c) reported the location of “M” on a 20-minute basis; and (d) sent by affixing a neighboring photograph upon arrival at the destination;
