A. On June 16, 2017, the Plaintiff entered into a lease agreement (hereinafter “instant agreement”) with the Defendant on the amount of KRW 95,338,640, and the lease term of KRW 60,00, and KRW 1,66,90, and KRW 25,000 per annum, a deposit interest rate of KRW 17,860,00, and KRW 17,860,000, and the Defendant delayed the payment of the lease fees on at least two occasions, the instant agreement may be terminated. In the event the instant contract is terminated even if it is terminated, the Defendant agreed to pay the Plaintiff the unpaid lease fees by the date of early termination, provision, and termination.

B. After that, the Defendant delayed the payment of the lease fees of KRW 3,322,476 on two occasions from December 20, 2017 to January 20, 2018, and the instant complaint stating the Plaintiff’s declaration of intent to terminate the instant contract on the ground of the Defendant’s delinquency in payment of the lease fees was served on March 11, 2018.

C. The amount that the Defendant is liable to pay to the Plaintiff as of February 5, 2018 is KRW 83,450,627 in balance after deducting deposit KRW 17,860,00 from the aggregate of KRW 3,659,429, KRW 929, KRW 97, KRW 97, KRW 97, KRW 97, KRW 97, KRW 97, KRW 971, KRW 17,860,00, KRW 68,137, KRW 68,137 (i.e., KRW 3,659, KRW 429, KRW 97, KRW 93, KRW 971, KRW 389,09, KRW 137, KRW 17,860,00)

2. Determination:

A. According to the above facts finding as to the cause of the claim, since the contract in this case was lawfully terminated and terminated by the Plaintiff’s declaration of intent to terminate the contract in this case, the Defendant is obligated to pay to the Plaintiff damages for delay calculated at the rate of 25% per annum, which is the interest rate of delay damages, from February 6, 2018 to the day of full payment, with respect to the above KRW 83,450,627 as well as KRW 82,93,40 as well as KRW 82,93,40 as to KRW 3,659,429 as to KRW 97,193,971 as to KRW 17,860,00 as to KRW 17,860,0
