Punishment of the crime

D is a person engaged in agriculture; Defendant A is a person who operates a sports center; Defendant B is a person who operates a communications center; Defendant C is a doctor; Defendant E is a person who operates a pen.
The Defendants entered into a joint agreement with L Co., Ltd. (Dissolution on December 4, 2008) that purchased L Co., Ltd. (hereinafter “each of the instant lands”) and to carry out a new business of constructing and selling fences, containers and ancillary facilities on each of the instant lands around December 23, 2007, and the Defendants constitute a partnership relationship under the Civil Act.
On December 4, 2008, each land of this case, which was purchased by L, after the dissolution of L, was completed on December 4, 2008, belongs to the actual co-ownership of the Defendants, the registration shall be required for the co-ownership of the Defendants.
Nevertheless, the Defendants conspired to trust one of the joint owners of each of the instant lands to complete the registration of ownership transfer, and subsequently, on November 29, 2010, the Defendants completed the registration of ownership transfer under Defendant E-1 in the name of Defendant E.

Each investigation report (According to the above evidence, the defendants and L corporation are in a partnership relationship under the above business partnership agreement, each of the land of this case is a combination property under Article 271 (1) of the Civil Code, and since the partnership did not make a combination registration and instead, since the partnership was registered under the name of defendant E who is a partner, it shall be deemed that the partnership held a title trust with its members, the crime of violation of the law is found guilty (see Supreme Court Decision 2003Da25256, Apr. 13, 2006).
