1. 피고인은 2014. 10. 11. 20:30경 서울 중구 B에 있는 C은행 앞 노점에서 정당한 권한 없이 ‘샤넬’이 대한민국 특허청에 등록한 상표와 동일한 상표를 부착한 가짜 샤넬 귀걸이 등 별지 범죄일람표(1) 기재와 같이 귀걸이 총 34점을 판매 목적으로 소지하였다.

2. 피고인은 2014. 10. 25. 16:30경 서울 중구 D에 있는 E은행 앞 노점에서 정당한 권한 없이 ‘샤넬’이 대한민국 특허청에 등록한 상표와 동일한 상표를 부착한 가짜 샤넬 목걸이 등 별지 범죄일람표(2) 기재와 같이 목걸이 등 총 17점을 판매 목적으로 소지하였다.
