Defendant shall be punished by imprisonment for a term of one year and two months.
However, the above sentence shall be executed for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
"2018 Highest 748" Defendant is also a person who has operated Oral meat processing business C (State) and D, and Oral meat processing business F and G in Hacheon-gun E in Haak-gun, Chungcheongnam-gun, Chungcheongnam-do, Chungcheongnam-do.
1. C wages, retirement allowances, and arrears in payment of retirement allowances for agricultural companies;
A. The Defendant in arrears with wages did not pay KRW 10,50,000 out of the wage for the above company from May 1, 2017 to February 1, 2018, to KRW 133,06,515 of the total wages of 30 workers, as shown in the attached Table of Crimes (1) including KRW 10,50,000, out of the wage for the above working period of victim H, who retired from office, within 14 days from his/her retirement without agreement on the extension of the payment date between the parties concerned.
B. The Defendant in arrears with retirement allowances, as above, did not pay 109,01,924 won, including 12,953,213 won of the victim I’s retirement allowances, retired from the said enterprise while working in the said enterprise from April 23, 2010 to February 1, 2018, within 14 days from the date of retirement, without any agreement between the parties on the extension of the due date.
2. Delayed payment of D wages and retirement allowances;
A. The Defendant in arrears with wages did not pay KRW 23,509,540 of the total wages of five workers within 14 days from the date of retirement without agreement between the parties on the extension of the due date of payment between the parties, as stated in the attached Table of Crimes (2) including KRW 4,528,530 from July 13, 2015 to January 29, 2018, when working at the above company from July 13, 2015 to January 29, 2018.
B. The Defendant in arrears with retirement pay is indicated in the attached list of crimes (2) including the victim J’s retirement pay of KRW 1,325,934 who retired while working as described in paragraph (2) while operating D as above.
