The judgment below

In light of the records, the court below reversed the judgment of the court of first instance which found the defendant guilty on the facts charged of the non-guilty portion of this case on the grounds as stated in its reasoning and found the defendant not guilty. There is no violation of the law of logic and experience and the principle of free evaluation of evidence by failing to exhaust all necessary deliberations, or by exceeding the bounds of the principle of free evaluation

On the other hand, although the prosecutor appealed to the entire judgment of the court below, the prosecutor did not state the grounds of objection in the petition of appeal or appellate brief.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
